Ergo Nav Lifetime Warranty
on Workmanship and Materials

1. Dr. Steven R Jones’ “ERGO NAV Adjustable Computer Mouse Platform” is warranted against defects in workmanship and materials, including adjustment points worn to the point they will no longer hold securely, under normal use for as long as the original purchaser owns the ERGO NAV after date of purchase from Dr. Steven R Jones unless otherwise stated. (Proof of purchase is required). Any product which is determined by Dr. Steven R Jones or his management staff to be defective in material or workmanship or is worn beyond functioning correctly, and returned to Dr. Steven R Jones, shipping costs prepaid, shall be, as the sole remedy, repaired or replaced at Dr. Steven R Jones’ option.


2. This warranty is expressly in lieu of all other warranties expressed or implied, including the warranties of merchantability and fitness for use and all other obligations or liabilities on the part of Dr. Steven R Jones, and Dr. Steven R Jones neither assumes nor authorizes any other person to assume for it, and other liability in connection with the sale hereunder. Dr. Steven R Jones disclaims any liability for product defects that are due to product misuse, improper product selection or misapplication.


3. Dr. Steven R Jones shall not be liable for customer's costs, lost profits, good will or other special or consequential damages. Dr. Steven R Jones’ liability in all events is limited and shall not exceed, the value of merchandise involved.


4. Dr. Steven R Jones shall not be liable for customer's costs of damaged equipment used in conjunction with ERGO NAV such as a Mouse or Chair Arm).


5. Remedies - Any controversy or claim arising out of or relating to the contract, or the breach thereof, shall be settled by arbitration in San Diego County, State of California in accordance with the commercial Arbitration Rule of the American Arbitration Association, and judgment on the award render by the arbitrator(s) may be entered in a court having jurisdiction there of.
